1.1 The Service (a) Optus Push to Talk allows customers
using a compatible Push To Talk handset to talk with one or all members of a
predefined group by pressing a button on their handset. The voice message is
delivered to the other member(s) of the group, who push the button to respond.
a) The duration of each voice message is limited to 60 seconds. (b) One to One
and Group Calling a) A Push to Talk subscriber may call another subscriber or a
predefined group of Push to Talk subscribers. b) A Push to Talk subscriber may
have up to 5 members per group and may have up to 50 groups per service. c)
Optus may at its discretion allow eligible corporate customers to establish
groups with up to 50 members. d) To participate in one to one or group calling,
all participants must be Optus Mobile Digital postpaid subscribers with a
compatible Push to Talk handset. e) Groups may be created as: (A) “Open” which
means that once the group has been created and an invitation to join the group
accepted, any member of the group may invite others to join. (B) “Secured”
which means that only the creator of the group may invite others to join. (C)
In either “open” or “secured” groups, Optus takes no responsibility for
managing the inclusion of members in a group or moderating the group in any
way. (c) Optus reserves the right to change its Push To Talk platform at any
time. Should a change of platform occur, Optus does not guarantee that all
features and capabilities of the customer’s handset will continue to
function.(d) The service is available for use within Optus’ existing GPRS
coverage area in Australia. (e) Optus Push to Talk customers are unable to use
this service to talk with Push To Talk users on other operators' networks in
Australia.
1.2 Eligible Customers Optus Push to Talk is available only to customers Optus
classifies as Business Customers and who are an approved corporate or
government entity as defined by Optus.
1.3 Activation and Deactivation (a) To activate Optus Push To Talk, customers
must request Optus to provision MMS and GPRS on their applicable mobile service
and be registered for the Optus Push to Talk service. (b) Where the customer
sends an MMS, the customer will be charged for the number of MMS sent
multiplied by the MMS rate specified in the customer's rate plan. Section 9 of
Table A in the Optus Mobile Standard Pricing Table applies. (c) If a customer
no longer requires the Optus Push to Talk service, the customer must cancel the
Push To Talk service or request that Optus cancels the Push to Talk service. a)
If the service is not cancelled and another user inserts an active Optus SIM
into the Push to Talk registered handset: (A) the Customer may be billed for
the Push To Talk usage of any subsequent user of the Optus Push to Talk
registered handset. (B) the subsequent user of the Push to Talk registered
handset may participate in the groups of the Customer as if the user was the
Customer.
1.4 Fair Go Policy (a) Usage of Optus Push to Talk is subject to the Optus Fair
Go™ Policy. (See Appendix W for details).
1.5 Roaming (a) Optus Push to Talk may be used wherever Optus has GPRS roaming
agreements with overseas carriers. (b) Additional charges will apply if Optus
Push to Talk is used while roaming on a partner network. See the Optus Mobile
Services Standard Pricing Table - Table A for details.
1.6 Handset Requirements (a) Customers must have a Push To Talk handset that is
compatible with Optus’ Push To Talk platform. (b) Optus does not guarantee that
all Push To Talk capable handsets available in the market are interoperable
with: a) the Optus Push To Talk offering, or b) any other Push To Talk capable
handset.
1.7 Corporate Web Tool (a) The Optus Push To Talk Corporate Web Tool is
provided to eligible, approved customers for the purpose of managing end user
access to the Optus Push To Talk service within the customer's organisation.
(b) Provision and use of the Corporate Web Tool is subject to the terms and
conditions in the Optus Business Push To Talk Application Form.
1.8 Service Performance (a) Optus does not warrant that all messages will be
delivered, delivered instantaneously, delivered simultaneously or delivered
completely (b) Message delivery and call set up times can vary.
1.9 From time to time Optus may undertake promotions and make special offers in
relation to the service ("Promotions"). All Promotions are offered subject to
their terms and may be withdrawn or altered at Optus' discretion. The terms of
a Promotion will override these terms and conditions to the extent of any
inconsistency. Optus Push to Talk in whole or part may be suspended, changed or
terminated at any time without notice.
