Zoo general

You agree that Optus will charge you, and that you will pay for, all content, subscription services and downloads requested by you from any Optus Zoo website or portal. Including via SMS short code.

You will incur standard browsing charges for browsing throughout the Optus Zoo mobile portal.

Optus accepts no liability for any loss or damage as a result of a delay in receiving Optus Zoo content or not being secure or not received. Content may be suspended, changed or terminated without notice.

Optus Zoo content may only be used by the customer for personal and non-commercial purposes and not otherwise copied, published, republished, re-distributed, re-communicated or otherwise commercially exploited in any form or by any method whatsoever.

Optus will endeavour to provide current, accurate information but makes no warranty regarding the timely delivery, currency or accuracy of any information provided to you as part of the Optus Zoo updates service.

You should not rely on any information provided to you as part of the Optus Zoo service without independent advice.

Optus will not be liable (to the extent permitted by law) for any loss or damage suffered or incurred, directly or indirectly, as a result of reliance upon any information received.

Customers are only entitled to purchase up to $100 per calendar month of Content. This $100 limit does not apply to any usage or carriage charges associated with the delivery or request of Content over GPRS or CSD. Optus Fair Go™ policy applies.

Use of the Optus Zoo service overseas in compatible network areas will result in customers incurring any browsing, streaming and downloading charges at International Roaming Rates.

To use 3G services on Optus Zoo, you must be an Optus 3G mobile customer with compatible 3G video capable handset and be in a 3G network coverage area, or with a dual band compatible handset and SIM in a dual band coverage area. 3G handsets will not provide you with access to 3G services in areas where a dual band (2100/900 MHz) handset is required. Ringtones and Games on Optus Zoo

Your handset must be compatible with the content selected. When purchasing & downloading Trutones, Sound FX, Wallpapers, Screensavers & Polyphonic Ringtones via Optus Zoo on your mobile, the cost of the Content and any associated downloading charges are charged to your mobile account or your pre-paid balance.

PREMIUM GAMES PACK:

Availability

The Premium Games Pack ("Service") is available to Optus Mobile Digital and Optus Pre-Paid customers.

To receive the Service, you must subscribe via the Optus Zoo Mobile portal. To access the portal you must have a mobile handset with an XHTML browser. Customers must be provisioned for WAP GPRS and have the correct settings on their handsets.

By using or accessing the Service you agree to the terms of use set out at www.optus.com.au/standardagreements.

Pricing:

Standard GPRS downloading charges apply to all games.  Subscription to access the service is charged at $9.99 per month. The Premium Games Pack will automatically continue on a monthly basis until you unsubscribe from the service. The monthly subscription includes any 2 single player games from the Optus Zoo Games portal. These charges do not include access to any other Optus content or the Optus Zoo landing page and are in addition to Optus Browsing Packs, Data Plans, and Optus Zoo browsing charges you may accumulate.

Cancelling the Premium Games Subscription Pack:

To cancel your Premium Games Subscription Pack, SMS the word STOP to 19797465. There is no refund if you cancel before your monthly subscription ends.

General:

The Service is not included in Optus Mobile Pricing Plans, but is charged separately. The Service content and pricing may change at any time and you may cancel your subscription to the Service. There is no refund if you cancel before your monthly subscription ends.

You will pay standard Optus GPRS charges while navigating to the Service within Optus Zoo. Customers accessing the Service whilst roaming overseas will incur standard data roaming charges, in addition to the Service pricing.

Optus Pre-Paid customers must have sufficient credit in order to subscribe to the service and must maintain the minimum call credit required to access the Service. Optus Pre-Paid Customers who do not have sufficient credit to renew their monthly subscription at the end of each calendar month will have their monthly subscription cancelled.

Optus accepts no responsibility for content within the Service. The content within the Service may not be used for commercial purposes.

Mobile Internet Packs

Mobile Internet Packs (MIP): Include a set amount of data per month to access services on Optus Zoo, as well as browsing the Internet from your mobile. Excess usage will be charged at $0.35 per MB or part thereof for 12 or 24 months MIP plan customers, iPhone customers or ‘yes’ Internet Cap customers, $0.50 per MB or part thereof for month-to-month Mobile Internet Pack customers, or $0.10 per MB for ‘yes’ Social customers. Usage includes uploads and downloads. 

For 12 or 24 months MIP customers, if, before the end of your contract period, you cancel your service or change to a mobile plan without a MIP, a tiered charge of $12 for 12 month customers and $25 for 24 month customers will be applied to your account. Any unused data allowance cannot be rolled over. Your data allowance does not include services such as Data Roaming, Voice calls, Voice Mail, International SMS, premium and Third Party SMS, MMS, Optus Zoo subscription content and Third Party content and applications, International MMS, 1300 or 1900. If you are able to access such services, your use of such services will be charged at prevailing rates. The service is only available to customers within the Optus 3G/HSPA or GSM coverage area and is subject to network availability, refer to www.optus.com.au/coverage. The YouTube Service pricing:

You can elect to receive the Service through a number of ways:

1. Max Pack: You will be charged $5.99 per month for the monthly subscription to the MaxPack(customers who subscribed to the Max Pack prior to 16/02/09 will be charged $5.95 per month). This includes unlimited access to the MySpace Mobile Service and the YouTube Mobile Service.

2. Access via the Optus Mobile Internet Packs - Browsing charges apply as per the pricing of your Mobile Internet Pack.

To change pricing options you can visit the YouTube icon accessible within Optus Zoo (Optus Zoo > YouTube > Unsubscribe).

Cancelling Max Pack:

To cancel the Max Pack option, SMS the word STOP to 19753971 or visit your Account page, accessible via the Service (Optus Zoo > YouTube > Unsubscribe). There is no refund if you cancel before your monthly subscription ends.

Cancelling the Sports Pack

You can unsubscribe from the Super Sports Pack at anytime by visiting Optus Zoo > Sports > Super Sports Pack > My Subscriptions or by calling 1300 760 017 or by sending an SMS 'Stop Sport' to 19911008.

Sky News Video Day Pass: You will be charged an access fee of $1.00 which is valid for 24 hours. This includes unlimited access for 24 hours to the selected Sky News Video for the duration of the day pass (does not include access to any other Optus content, Optus Zoo landing page or any other video content outside of what is provided within the individual packs). These charges do not include access to any other Optus content and are in addition to Optus Browsing Packs, Data Plans, and Optus Zoo browsing charges you may accumulate. To change pricing options you can visit Sky News Video which is accessible within the Optus Zoo News channel.

The Service - The MTV Music Download Service (Service) is only available to either customers of Optus or of an Optus Service Provider (You). The Service allows You to: (a) stream music and an accompanying video clip (if applicable) (Streamed Music) to your mobile handset or to your stand alone personal computer (PC); (b) purchase a music file (WMA format); and (c) download the music file(s) that You purchased to your PC only.

Licence - The license to stream, Streamed Music to your mobile handset or PC, or to download a music file to your PC is granted to You on a non-exclusive and non-transferable basis for your own personal non-commercial use. You can receive up to a maximum of 30 seconds of Streamed Music to your mobile handset or PC.

Streamed Music is provided for promotional purposes only. You can only download a music file to your PC within Australia and via an Australian internet service provider (ISP) account. You must download a Digital Licence before You are able to play a track. The music files are downloaded in the form of WMA files. The WMA files are protected by Digital Rights Management 1000.

MOB MUSIC

Please read the following Terms and Conditions before using Mobile Music. By using Mobile Music, you are deemed to have accepted these Terms and Conditions.

The Mobile Music Service ("MobMusic Service") is available to customers of the Optus Mobile Digital and Optus Pre-Paid mobile service in Australia. This will also be applicable to such customers who may be roaming outside Australia. Customers must have a handset compatible with the MobMusic service. The MobMusic application can be downloaded from the Optus Zoo WAP site. Standard GPRS charges apply to navigate within Optus Zoo.

You agree to pay charges of $3.75 per week until you cancel your subscription. You can cancel your subscription at any time by clicking the unsubscribe option (Options > Subscription Status > Unsubscribe) or SMS 'Stop' to 1970 3666. There is no refund if you cancel before your monthly subscription ends.

By downloading the application you will receive message alerts from Optus notifying you of new Bonus Tracks and Artists of the week. To cancel alerts select Options > Settings > SMS alerts from the MobMusic menu.

Optus Pre-Paid customers must have sufficient credit in order to purchase the Music Pack and must maintain the minimum call credit required to access the Service. Optus Pre-Paid Customers who do not have sufficient credit to renew their weekly subscription at the end of each week will have their subscription cancelled.

If you cancel your subscription you will not be able to access tracks that you downloaded to your music library (Playlist). Your music library (Playlist) will be stored for a minimum of 3 months. If you re-subscribe within this time your Playlist will be restored.

All Songs provided by Mobile Music are in encrypted format and users will not be able to play them on any other audio/video player or 3rd party application. Even if you have installed the application on your phone memory, all songs will by default get downloaded onto the Memory card. Only in the absence of a memory card songs will be saved on phone memory.

Optus warrants that the application shall be free from virus, trojans, spyware, malicious hardware or software limiting functions or devices. However, Optus shall not be responsible for any virus, trojans, spyware, malicious hardware or software limiting functions or devices that may affect the Application as a result of internet access or any other connection that may be established by the Mobile user.

All content is being provided on an "As-Is" basis. You must not modify, copy, sell, transfer, assign, reproduce, publish, republish, promote, frame, upload to a third party, communicate, re-communicate, post, transmit, distribute or re-distribute any content contained in the service in any way or by any method whatsoever. You must abide by all applicable laws relating to music content.

Optus accepts no responsibility for content within the Service. The content within the Service is for personal use only and may not be used for commercial purposes.

Some of the content may be explicit, and subscriber discretion is advised. Optus accepts no liability on grounds that any content may seem explicit, vulgar, obscene, defamatory or otherwise unacceptable to any subscriber.

Hot Hits

Availability:

The Hot Hits Mobile Site is available to Optus Mobile Digital and Optus Pre-Paid customers via the Optus Zoo WAP portal. To access the Optus Zoo WAP portal you must have a mobile handset with an XHTML browser. You can also access the service by sending an SMS with keyword "HITS" to 966 that will subsequently deliver back a WAP link to the site. The 966 service is only available to those with WAP compatible handsets.

Hot Hits Alert:

When you SMS 'HITS' to 966 you will automatically receive a free weekly alert to advise of new content available on the Hot Hits Mobile site. There is no charge to receive the alert or to click on the link in the alerts and access the Hot Hits mobile homepage.

You may cancel your alerts at any time by going to the my alerts section within the Hot Hits mobile site or alternatively you can send "STOP" + the following keyword to 1972 8364:

1. "STOP AM" to cancel the morning daily alert.

2. "STOP PM" to cancel the afternoon daily alert.

3. "STOP WEEK" to cancel the weekly alert.

Or "STOP" to cancel all your Hot Hits alerts subscriptions.

The Hot Hits Content pricing:

The pricing of the Hot Hits content is as follows:

13. Optus Zoo Content, subscription services and downloads are only available to Optus Mobile Digital customers (unless otherwise stated) and participating Service Providers' customers with compatible handsets.

14. When downloading Optus Zoo Content (except Mobile Games) via WAP, the cost of the Content and the WAP standard charges according to your data plan will apply irrespective of whether the download is successful.

15. Customers are only entitled to purchase up to $100 per calendar month of Content. This $100 limit does not apply to any usage or carriage charges associated with the delivery or request of Content over GPRS or CSD.

You will receive an SMS message during the installation process to confirm your subscription. This SMS is free to receive.

Cancelling the Service:

To cancel your Service, SMS the word STOP to 19920008. There is no refund if you cancel before your monthly subscription ends. There are no charges associated with sending an SMS to 19920008. You will receive a free reply message confirming your subscription cancellation.
